1. Agreement to Terms
By accessing or using Purevive ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Platform.
Purevive is a marketplace connecting travelers with local experience providers in Bali, Indonesia. We facilitate bookings but are not the provider of experiences.
2. Eligibility
To use Purevive, you must:
- Be at least 18 years old (or 16 with parental consent)
- Have the legal capacity to enter into binding contracts
- Provide accurate and complete registration information
- Not be prohibited from using the service under applicable laws
3. User Accounts
3.1 Account Creation
You may browse experiences without an account, but booking requires registration. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
3.2 Account Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Provide false or misleading information
- Engage in fraudulent or illegal activities
- Abuse the platform or other users
4. Bookings and Payments
4.1 Making a Booking
When you book an experience through Purevive:
- You enter into a direct contract with the experience provider
- Payment is processed securely through Stripe
- A confirmation email is sent with booking details
- An 8% service fee is added to cover platform costs
4.2 Pricing
All prices are displayed in your selected currency. The final price includes:
- Experience cost (set by the provider)
- Service fee (8% of subtotal)
- Any applicable taxes
4.3 Payment Security
We use Stripe for payment processing. We do not store full credit card details on our servers.
5. Cancellation and Refunds
Important: Cancellation policies are set by individual experience providers and vary by booking.
5.1 Traveler Cancellations
- 48+ hours before: Full refund (minus service fee)
- 24-48 hours before: 50% refund
- Less than 24 hours: No refund
Some experiences may have stricter policies. Check the specific experience for details.
5.2 Provider Cancellations
If a provider cancels your booking:
- You receive a full refund including service fee
- We'll help you find an alternative experience
5.3 Weather and Force Majeure
For weather-dependent experiences, providers may:
- Reschedule to another date
- Offer a full refund if rescheduling isn't possible
6. Experience Providers (Vendors)
6.1 Vendor Registration
To list experiences on Purevive, providers must:
- Submit a vendor application with valid business documentation
- Provide accurate experience descriptions and pricing
- Maintain appropriate licenses and insurance
- Comply with local laws and safety regulations
6.2 Vendor Responsibilities
Experience providers agree to:
- Deliver experiences as described
- Communicate promptly with travelers
- Maintain safety standards
- Honor confirmed bookings
6.3 Commission
Purevive charges a 15% commission on each completed booking. Payouts are processed weekly to registered bank accounts.
7. User Conduct
You agree not to:
- Use the platform for any illegal purpose
- Harass, abuse, or harm other users or providers
- Post false, misleading, or defamatory content
- Attempt to circumvent the booking system
- Scrape or collect data without permission
- Impersonate others or misrepresent your identity
- Interfere with the platform's operation
8. Reviews and Content
8.1 User Reviews
After completing an experience, you may submit a review. Reviews must:
- Be based on your actual experience
- Be honest and accurate
- Not contain offensive or inappropriate content
- Not violate anyone's privacy
8.2 Content License
By posting content (reviews, photos) on Purevive, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content on our platform.
9. Intellectual Property
The Purevive platform, including its design, logos, and content, is protected by intellectual property laws. You may not:
- Copy, modify, or distribute our content without permission
- Use our trademarks without authorization
- Reverse engineer our software
10. Limitation of Liability
Purevive acts as a marketplace connecting travelers with providers. We are not liable for:
- The quality or safety of experiences provided by third parties
- Actions or omissions of experience providers
- Personal injury or property damage during experiences
- Disputes between travelers and providers
Our total liability is limited to the amount you paid for the booking in question.
11. Indemnification
You agree to indemnify and hold harmless Purevive and its officers, employees, and partners from any claims, damages, or expenses arising from:
- Your use of the platform
- Your violation of these Terms
- Your violation of any rights of another party
12. Dispute Resolution
For disputes between travelers and providers:
- First, attempt to resolve directly with the other party
- Contact Purevive support for mediation assistance
- If unresolved, disputes will be handled under Indonesian law
Disputes with Purevive shall be resolved through binding arbitration in Bali, Indonesia.
13. Modifications to Terms
We may update these Terms at any time. We will notify you of material changes via:
- Email to your registered address
- Prominent notice on the platform
Continued use after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of Indonesia. Any legal proceedings shall take place in the courts of Bali, Indonesia.
